You had me til the 8th amendment: you changed the word and (from the Constitution) to or (on the tee).
The Constitution does not ban the two clauses (cruelty and unusualness) individually, only in combination.
Most punishments could handily be classified as either cruel or unusual. A prison term is cruel - that is part of its intent. But if the sentence is applied to all similar offenders, then it isn’t unusual. And sending a young DUI offender to do volunteer hours at the morgue instead time in jail may be unusual, but not cruel.
Yeah, I would have bought it otherwise.
