can i use this to pump water out of a stream to use for a nearby garden?

Are these gasoline or diesel?

All 3, according to the Powermate website, use regular gasoline.

Technically it looks like you’d be able to, but you might want to make sure that legally you’re able to. Is the creek on your land, or is it owned by someone else? Also, how much water will you be pulling out of the stream versus what’s left in the stream? If you divert too much water, it stops downstream, and you don’t have a way to refill the stream (overflow flows back into the stream), you could be in trouble.

Additionally, these pumps might be overkill unless you have a big garden. You could probably use a smaller submersible electric pump like you’d see in a sump pump or in a garden pond that you can just drop into the stream when you need the water.

it flows through my land and flows to a water fall nearby then to a big river. i also wonder if i could dig a small pond could this fill it? also wonder if during a power failure if i could pump water to my house from here.
