Toughbuilt, which is not Dewalt, but uses a nearly identical yellow on their products could easily be mistaken for Dewalt brand products. By including them in a “Dewalt” sale, Woot is adding to the “likelihood of confusion in the marketplace” ← a term used by IP lawyers to win big $$$$$ from litigation.
