Hello. This version of Eyeore is from Disney. Has it entered the public domain? Or if I put sunglasses on a character does it automatically become public domain?

Hello. Tigger is not in the public domain, but most of the other characters including Eeyore are. Disney added a red shirt to Pooh, so they still claim copyright for that character drawn specifically with a red shirt. I am unaware of them making such changes/claims on the use of Eeyore. I drew him in a raggedy style rather than a clean Disney style and with the small dots for eyes rather than the large Disney eyes although I guess it is hidden by his glasses. Of course, I am not an expert on this stuff. Thanks for asking though.

I thought you did a great job avoiding copyright, and I believe it will sell well on any site, including here on Woot. But the question is: the design is not within the theme that is Public Domain. The other 3 designs you submitted are perfectly within this week’s theme. And they were very good too.

I think Eeyore is in the Public Domain, but what do I know? As to selling on other sites, I assume Disney will just use keywords to have anything Winnie the Pooh related taken down on places like TeePublic and elsewhere. I think they are quite happy ignoring Public Domain and just trampling over artists. Good luck fighting with them over it.

Man, I’ve been trying to understand this thing about what you can and can’t use with registered pop culture characters for over a decade now and every time I stop to think about it I feel like I know less. But one thing is certain, each pod store handles this differently.

Places like TeePublic that let anyone upload whatever they want, seem to just take down anything that they get a complaint about (often just based on keywords). They do not really bother to see if the complaint is legit. They don’t really care and just want to avoid any legal trouble.

I admit to often stretching the rules of the derby (I think Eeyore is OK, but I guess it is not up to me). I try to make stuff that (I hope) will sell well rather than stuff that fits more perfectly in the derby theme. For the handful of artists that fog with almost all of their submissions, they can fight over the $1k and not worry if they only sell 20 shirts. For the rest of us (and I would include you in that) we have to care about making stuff that the public will want to buy if we are lucky enough to make it into the side sale. Ultimately, the buyers do not care about a derby theme. That is just a starting point for the artist. The buyers just want shirts that they want.

This thing about using the theme only as a starting point and not as the biggest criterion for choosing the 3 winners is great. I have two personalities when I create artwork. One of them makes art that I would like to wear myself and the other personality aims for the site’s audience to buy. When I try to make something that I imagine will sell a lot on Woot, I always make a mistake and it doesn’t sell at all. I think that’s why they don’t choose many of my drawings here. I’ve already proven that I don’t know what Woot’s customers like.

Yeah- I am lucky enough that a lot of the stuff I would wear is based on Nostalgia from the 70s and 80s which is a good fit at woot, but maybe not at other sites. Going into each derby knowing that the same handful of artists will have all of their stuff in the fog is freeing in the sense that I feel comfortable not worrying about votes and trying to focus on making stuff I like. (It is frustrating as well, but I try to not dwell on it and try to view the positive aspects- otherwise, I would just quit the derby for good)

Well you are strait up my favorite artist here I think you do a great job. I was wondering one thing does the Amazon woot follow the old woot rules where the voting is concerned when I started buying tshirts a person had to have bought a shirt to be able to vote in the Derbys that is why I bought my first woot shirt… oh and did the ray of sunshine win? I never know where to look to find the final results of a Derby.

Thanks! Unfortunately, some artists flood the derby with votes from people who have never and will never buy anything from woot (just take a look at the fog most weeks and the very low sales of some of the shirts that “win”). I do appreciate the support though. Even though the woot buyers are having their voices minimized by this voting behavior, getting a bunch of votes and getting near the fog makes it more likely that a design will get printed. I think the Eeyore design got somewhere around 10th place which is pretty good. Fingers crossed that the editors decide to put it into the side sale which is normally on Friday. :slight_smile:

Your my other favorite I look through all the offers and vote for you to period I rarely vote any other artists it seems like you to are more original than most it is crazy to me that the sam 3 designs win every week and I am quite tired of them I have developed a twitch when ever I hear the Beatles now not sure why. :wink:
Anyway I just happen to have more Kg07 shirts than acraigl shirts have you slowed down on entering the FOG or am I missing your work I am sure I need more I will look in the catalog next tshirts sale. So I have more of yours also :grin:

I don’t want to speak for Andy (although I know he is still participating in the derby- just not every week right now), but it is very demoralizing to see what goes on in the fog every week. I am too stubborn to stop submitting to the derby (for now), but I know that some of the best artists at woot have stopped participating on a regular basis (Fishbiscuit5, for one) because of the voting situation. I am sure that as this continues, it is also minimizing the interest of the woot voters. One possible solution would be to get rid of the cash prize for “winning” the derby. Without that prize, there would be far less incentive to manipulate the derby by flooding it with “votes.”

Also, I guess I take some (not all!) of the blame for your twitch when you hear the Beatles. When I did the “The Beagles” design I thought it was harmless fun and it made sense because Beatles and Beagles were fairly close. I had no idea what would follow at woot. :frowning:
